The penalties for an underage DUI will depend on a number of factors. While a basic, first-time underage DUI is punishable by a license suspension, there are other factors that can lead to enhanced penalties. These factors include:
- Driving with a BAC between .05 and .08
- Driving with a BAC above .08
- Causing a fatal accident or a DUI accident with injury
- Driving with other minors in the vehicle, especially a minor younger than 14 years old
