The Circumstances of an Orlando DUI Arrest

While the circumstances of every case will vary depending on a number of factors, the following are basic details as to what you can expect may occur during an Orlando DUI arrest:

  • A law enforcement officer observes or receives a report of a driver violating a traffic law or driving carelessly on the road.
  • The law enforcement officer pulls the driver over to the side of the road.
  • The officer obtains the driver’s license and registration information and asks the driver where he/she was going, if he/she has been drinking, etc.  At this time, the officer will be looking at the driver for any clear signs that suggest intoxication.  These signs may include slurred speech, open alcohol containers in the vehicle, bloodshot eyes or statements made by the driver about how much he/she has been drinking.
  • If the law enforcement officer feels that the driver shows signs of intoxication, the officer will ask the driver to step out of the vehicle and perform a series of field sobriety tests which may include such actions as gauge balance, coordination and an ability to follow simple instructions like stand on one leg or walk heel-to-toe in a straight line.
  • If the law enforcement officer feels that the driver is unable to perform the field sobriety test effectively, the officer may decide to arrest the driver for DUI.

After a drunk driving arrest is made, the driver will then face a breath or blood test to measure his or her blood alcohol concentration (BAC) and may then be formally charged with DUI.
